Special Needs Planning
We take a personalized, life span approach to special needs planning for individuals of all ages with disabilities, and their families. As an example, the planning needs for a young child with birth injuries are different from those of an adult with developmental disabilities whose parent has just died. Our work includes meeting with the individual and family members to understand their goals and needs, preparation of special needs trusts to shelter assets while retaining eligibility for essential public benefits, assistance in selection of trustees and care managers and preparation of other important legal documents for the individual with disabilities to the extent he or she is able and for family members. We serve as counsel to trustees to assist them in meeting the strict requirements of Maryland’s Department of Health and Mental Hygiene and Supplemental Security Income, to work effectively with their beneficiaries and to modify trusts through court intervention when necessary.
